I've used google and I can't find any solid information. Is using a MP3 as background music for your webpage illegal? If so, why is everyone doing it? Two more questions. Will bluehost ban you if you have an illegal MP3 on your server? Do they have the rights to go through your files and folders on your server?

Just because everyone is doing it, does not make it right or legal.

Bluehost does not allow ANY illegal content on their servers. Distributing copyrighted material is illegal. Using an MP3 that is copyright as your backgound is illegal becasue people can download that MP3
